By accessing this website we assume you accept these terms of service in full. Do not continue to use Jamtap's website if you do not accept all of the terms of service stated on this page.
The following terminology applies to these Terms of Service, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms of service. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of United Kingdom. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Definitions
1. “Jam” or “Jams” are musical compositions and sound recordings created under these terms of service.
2. “Buyers” are purchasers of services on Jamtap and Licensees of a Jam or Jams under these terms of service.
3. “Sellers” are performers of services on Jamtap.
Overview of Services (Main Features of the Service)
· This Site is offered to users who are 13 years of age or older. By using this Site, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements. If you are under the age of 13, you must not access or use the Site.
· Buyers are able to buy services through Jamtap through ordering a Jam/s.
· Buyers pay in advance when ordering a Jam.
· Buyers order a Jam by completing a “Create a Jam” form, entering the Jamtap checkout and finally pressing the “Purchase” button.
· Jamtap matches Buyers to suitable Sellers who perform the services ordered.
· Once your Jam has been accepted by a Seller, the Buyer will receive a notification confirmation.
· In the event Jamtap is unable to match a Buyer order to a Seller, the Buyer will be notified and a full refund will be issued.
· The Seller has the right to reject a Jam order on any grounds.
· In instances where the Jam order is obscene or offensive the Seller is expected to report the Buyer to Jamtap for consideration.
· Once the Seller has accepted a Jam order, they have 5 work days to complete the order.
· If the Seller is unable to complete the Jam order in 5 work days a full refund will be offered to the Buyer.
· Once a Seller completes a Jam order, Jamtap facilitates sending the Jam to the Buyer via email and/or whatsapp.
· The Jam will be delivered to the Buyer as a web link or file copy at the discretion of Jamtap.
· The Buyer then may rate the jam and see some information about the musician (Seller) who performed it.
· In the event that a mistake has been made in the Jam, a request for edit can be made by the “Buyer” via email to info@jamtapmusic.com.
· The Buyer has the rights to share the Jam for personal use through social media and/or other channels
· The Buyer does not have any rights to sell or otherwise use the Jam for commercial purpose.
· The Buyer has an exclusive license to the Jam ensuring the privacy of their message.
· The privacy of the Buyer is protected as are any names or familiar names used in the Jam.
· All other lyrics are permitted for derivative works under the creative commons license excluding where the lyrics infringe on an existing copyright.
· Jamtap may analyse Jams with the Jamtap musician community in order to improve the service in aiming for the best possible experience for Buyers.
· A version of the Jam with all names or familiar names audibly protected or interchanged may be used by Jamtap or the Seller to advertise the service.
Acceptable Uses
Below is a list of rules that apply to Jamtap service usage. By using Jamtap you agree that:
For Buyers and Sellers:
1. You will not submit any content that: (i) is libellous, defamatory, abusive, threatening or harassing; (ii) is hateful or offensive; (iii) is violent or vulgar ; (iv) is illegal or encourages illegal activity; or (v) infringes or violates any right of a third party or any domestic or international law, rule or regulation including, but not limited to, copyright, patent, trademark, trade secret or other proprietary or contractual rights; right of privacy or publicity; or any confidentiality obligation.
2. You will not impersonate any person or entity or misrepresent your identity.
3. You will not engage in any criminal activity or conspiracy to commit any criminal activity.
4. You will not delete any legal notices, disclaimers or proprietary notices such as copyright or trademark symbols, or modify any logos that you do not own or have express permission to modify.
5. You will not submit or otherwise make available any software or other computer virus or other harmful component, or otherwise impair or damage the Jamtap Site or another user’s hardware or software.
Although Jamtap will do our utmost to hold all users to these terms of service, we do not assure that other users are or will be complying with the foregoing rules or any other provisions of these terms of service. As between you and Jamtap, you hereby assume all risk of harm or injury resulting from any such lack of compliance.
For Sellers:
1. You own or possess the necessary rights to use, and to authorise Jamtap to use, distribute or otherwise utilise in all manners permitted by these terms of service all copyrights, trademarks, patents, privacy and publicity rights and/or other proprietary rights contained in content that you submit to us.
2. From the point of time you accept a Jam order, you will process it by performing the Jam and make it available to the Buyer within 5 work days.
3. The Jams created by you shall only be referenced or shared with third parties through the Jamtap operational distribution process.
4. You will not use any Buyer’s information, personal or otherwise, for any purpose not authorized by these terms of service unless prior written consent from Jamtap and the Buyer has been granted.
For Buyers:
1. You are using Jamtap for personal purposes only. Commercial uses are prohibited except where written consent from Jamtap has been given.
2. You will not submit a message that is obscene or offensive. Any profanity is grounds for rejection of a song. Mild profanity may be accepted at the discretion of Jamtap and Seller (examples of mild profanity include the words “damn”, “fool”, etc. )
3. You do not have license to sell or otherwise profit from the Jam.
4. You are able to share for personal enjoyment only and not for any exchange of costs.
5. You do not own any rights related to the song but do retain rights to privacy over the message you submitted to Jamtap regarding any names or familiar names used in the Jam.
6. Jamtap will never distribute your message with the names an familiar names audible for marketing or any other purpose unless you have specifically given your permission. However Jamtap has the right to use the Jam for marketing purposes when names and familiar names are not audible or have been interchanged.
7. Jamtap or the Seller may request your permission to use an unaltered version of your Jam for marketing or other purposes.
8. You own or possess the necessary rights to use, and to authorise Jamtap to use in all manners permitted by these terms of service all copyrights, trademarks, patents, privacy and publicity rights and/or other proprietary rights contained in content that you submit to us. Your Jam requests are unique to you and are not under copyright of another entity.
9. You will not use any other user’s information, personal or otherwise, for commercial purpose or direct financial gain.
10. You will not use an automated program to engage in Jamtap services.
11. All elements of your message other than names and familiar names will be reusable by yourself and others under the creative commons license, except in cases where you have infringed on anothers copyright.
Cookies
We employ the use of cookies. By using Jamtap's website you consent to the use of cookies in accordance with Jamtap's privacy policy.
Most of the modern day interactive web sites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate / advertising partners may also use cookies.

Unless otherwise stated, Jamtap and/or it's licensors own the intellectual property rights for all material on Jamtap. All intellectual property rights are reserved. You may view and/or print pages from www.jamtapmusic.com for your own personal use subject to restrictions set in these terms of service.
You must not:

2. Sell, rent or sub-license material from www.jamtapmusic.com

Redistribute content from Jamtap (unless content is specifically made for redistribution).
Through use of Jamtap services, Seller agrees to hereby grant to Buyer, an exclusive license to use Jams for Buyer’s personal, non-commercial use only, provided that (1) Buyer keeps intact all copyright and other proprietary notices, and (2) Buyer does not use the information or materials in a manner that suggests an association with any of Jamtap products, services or brands. Customer may upload the Jams to social media networking websites. Buyer:
· Shall not use the Jams in commercial projects
· Shall not make or authorize any use of the Jams for commercial purposes.
· Shall not sell or make commercially available the Jams.
· Shall not use the Jams in connection with unlawful content.
· Shall not grant any sublicenses to any third party without the prior express written consent of the Seller which may be withheld for any reason.
The Seller shall retain all right, title and interest in the Jams as well as any modifications made to the Jams by you and use of the Jams by you is limited only to what has been designated in these Terms of service. You acknowledge that Seller owns all right, title and interest in and to the Jams except those rights specifically granted to Buyer and Jamtap herein. Jamtap, however, does not warrant that Seller or Buyer own any or all right, title and interest in and to the Jams, including, but not limited to, the copyrights in the Jams. Further, Jamtap does not warrant that the Jams do not infringe any valid right of any third party.
Claims of Copyright Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Jamtap the following information (1) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (2) identification of the copyright work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site; (3) identification of the material that is claimed to be infringing or to be the subject of infringing activity and information reasonably sufficient to permit us to locate the material; (4) information reasonably sufficient to permit us to contact the complaining party; (5) a statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (6) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
